High Court questions legality of power tariff hike

The High Court on Sunday issued a rule asking the authorities concerned why the decision of Bangladesh Energy Regulatory Commission (BERC) taken on November 23 for hiking its power tariff at the retailer and wholesale levels, would not be declared illegal.

A HC bench of Justice Moyeenul Islam Chowdhury and Justice Md Ashraful Kamal issued the rule after hearing the writ petition.

The chairman of BERC and the secretary Power, Energy and Mineral Resources ministry have been asked to reply the rule within four weeks.

Engineer Mobashwar Hasan filed the writ on May 23 challenging the decision.

Barrister Jyotirmoy Barua, who stood for the petitioner, said that the BERC had held a mass hearing from September 25 to October 5 in last year, UNB reported.

According to the related law, it was supposed to give a written order within 90 days after mass hearing. However, without giving any written order, the government took the decision of tariff hike.
