HC gives probation to convict in landmark judgement

The High Court on Sunday, for the first time ever, handed down a landmark judgement in a narcotics revision case by giving an opportunity of probation to a convict.

On January 8, 2017, 45-year-old Moti Matabbar was convicted for five years in the narcotic case by a Dhaka court for possessing 401 pieces of Yaba tablets.

The case was filed in 2015. Later on May 11, 2017, an additional metropolitan sessions judge upheld his conviction.

A HC single bench headed by Justice Zafar Ahmed passed the verdict after sending the convict on probation on three conditions.

Advocate Shishir Monir, who stood for the convict, said, “In the conditions, Matabbar has been asked to take care of his mother, not give early marriage to his daughter and ensure the education of his children”.

“This is the second judgment passed by the High Court on the probation law in the history of Bangladesh. And this is the first verdict under special laws which is extremely promising and groundbreaking”, he added.
